One
of the foundations of the American way, as well as a tenant of International
Law, is that all people accused of crimes deserve to have legal representation.
Too often in small dictatorships suspects are whisked away in secret, tortured,
tried, and executed without the benefit of someone to represent them and
to help save their lives. The United States must certainly avoid
the mistakes that these nations make. That is, we must prove ourselves
better than our enemies. Moreover, the State is an "expert" when
it comes to trying and punishing people. Therefore the people need
an expert to help them defend themselves against the State. Without
the balance of power that fair, legal representation yields the State is
too readily free to overwhelm "the little people". Legal counsel
for detainees also forces trials to be more public as the Counselor serves
as a witness to the events that transpire.
Imagine yourself imprisoned in a foreign country on trial for a
crime. Could you respect that country's justice system if it didn't
allow you a lawyer or some kind or a fair trial? Suppose it
refused you legal counsel, kept you imprisoned without even charging you
with a crime, refused to release your identity (so that your family and
country wouldn't even know where you were) and refused to allow anyone
(such as Amnesty International) to observe your condition? Suppose
that country also refused to grant you POW status, wouldn't tell you when,
if ever, you might be released, and kept you locked away in a secret, remote
place indefinitely? This is exactly what the U.S. is doing, right
now, to it's detainees in Guantanamo Bay, Cuba. They call it Camp
X-Ray.
